Annually, a significant number of claims are referred to the disciplinary court of Mashhad medical council (MMC). The aim of this study was to investigate claims submitted to this office. Methods: This study was done on 334 claim files submitted to the disciplinary court of MMC in 2011. Data were recorded on a pre-designed checklist. Data included gender of plaintiff, subject of claim, relationship of plaintiff with patient, gender of defendant(s), defendants’ field of expertise, the judgment of board of experts, board of magistrates and board of appeals. Results: In total, 285 (85%) files which were finalized through judgment process were enrolled. Among the plaintiffs, 69% were male, 25% females, 4% MCC and 2% Mashhad University of Medical Sciences (MUMS). Regarding field of expertise, most claims were related to gynecologists (16%), dentists (15%), general practitioners (13%) and orthopedics (12%), respectively. According to the judgment of board of experts, 65% of defendants acquitted, 30% were sentenced of malpractice and 5% of cases were closed or plaintiff acquiesced. Most of the proven malpractices were related to general practitioners (21%), dentists (21%), gynecologists (9%), orthopedics (8%) and ear, nose and throat specialists (6%), respectively. Conclusion: Claims about medical community is an important issue requiring special attention. Physicians should pay enough attention to their patients’ problems and should consider professional commitments. In addition they should study and update themselves about medico-legal laws to reduce number of claims and possibility of being sentenced.}, keywords = {Medical Liability,Malpractice,Medical Council}, title_fa = {بررسی شکایات ارجاع‌شده به دادسرای انتظامی سازمان نظام پزشکی مشهد}, abstract_fa = {پیش‌زمینه: با پیشرفت علم پزشکی و بهبود سطح خدمات در ایران، میزان آگاهی عموم جامعه از حقوق خود در محیط‌های درمانی نیز افزایش یافته است. سالانه تعداد قابل توجهی از شکایات به دادسرای انتظامی سازمان نظام پزشکی ارائه می‌شود و هدف از این مطالعه بررسی شکایات واصله به این نهاد می‌باشد. روش‌ها: این مطالعه توصیفی بر روی 334 پرونده شکایات ارائه شده به دادسرای انتظامی سازمان نظام پزشکی مشهد در سال 1390 انجام شد. داده ها در چک لیست طراحی شده ثبت گردیدند. داده‌های جمع‌آوری‌شده شامل جنس شاکی، موضوع شکایت، نسبت شاکی با بیمار، جنس متشاکی (متشاکیان)، تخصص و رشته متشاکیان، نتیجه بررسی کارشناسی، رأی هیأت های بدوی و تجدید نظر بودند. یافته‌ها: در مجموع، (85%) 285 پرونده‌ای که اطلاعات کامل داشتند و به مرحله اعلام رأی رسیده بودند، وارد مطالعه شدند. در میان شاکیان 69% مرد، 25% زن، 4% سازمان نظام پزشکی مشهد و 2% دانشگاه علوم پزشکی مشهد بودند. بر اساس رشته و تخصص، بیشترین شکایات مطرح شده به ترتیب مربوط به متخصصان زنان (16%)، دندانپزشکان (15%)، پزشکان عمومی (13%) و متخصصان ارتوپدی (12%) بوده است. بر اساس بررسی هیأت کارشناسی؛ 65% از متشاکیان حکم برائت و 30% قصور دریافت کردند و در 5% موارد پرونده بایگانی شد یا شاکی رضایت داد. در میان قصورهای احرازشده، بیشترین فراوانی مربوط به پزشکان عمومی (21%)، دندانپزشکان (21%) و در وهله بعد متخصصان زنان (9%)، ارتوپدی (8%) و گوش، گلو و بینی (6%) بود. نتیجه‌گیری: شکایات از جامعه پزشکی مسئله‌ای مهم و نیازمند توجه ویژه است. پزشکان می‌بایست به مشکلات بیماران و تعهدات حرفه‌ایشان در مورد آنان دقت کافی داشته باشند. همچنین باید اطلاعات خود را در مورد مسائل حقوقی و کیفری حرفه خود افزایش دهند تا از تعداد این شکایات و امکان محکوم شدن کاسته شود.}, keywords_fa = {شکایت,قصور,سازمان نظام پزشکی}, url = {https://jmmc.mums.ac.ir/article_1829.html}, eprint = {https://jmmc.mums.ac.ir/article_1829_e57eeb970716b1a8ab1038abcc84c591.pdf} }
